1 – Introduction

These Terms of Service ("Terms") govern your use of the website and platform ("Platform") operated by SHOOT NOW! ("SHOOT NOW!", "we", "us", or "our").

 

SHOOT NOW! is not a provider of photography services.

We operate an online intermediary platform that connects photographers (independent contractors) with users who wish to book photography sessions. The photography service contract is formed directly between the user and the photographer. SHOOT NOW! is not a party to that contract.

 

By using this Platform, you agree to be bound by these Terms.

2 – Definitions

• "User" means an individual who books a photography session through the Platform.

• "Photographer" means an independent contractor registered on the Platform who provides photography services.

• "Photography Service Contract" means the agreement formed between the User and the Photographer for photography services.

• "Platform Fee" means the fee received by SHOOT NOW! for its matching, booking, and payment processing services.

• "Session" means the photography service provided by a Photographer to a User.
   

3 – Our Role and Scope of Responsibility

3.1 Role as Platform Provider

Our services are limited to the following:

• Providing a matching function between Photographers and Users

• Providing a booking management system

• Processing and remitting contractor fees to Photographers on behalf of Users

• Facilitating communication through our operations team
   

3.2 Items for Which We Bear No Responsibility

SHOOT NOW! accepts no responsibility for:

• The quality or content of photography services provided by Photographers

• Personal injury or property damage occurring during a Session

• Acts or omissions of Photographers

• Photo quality affected by weather, lighting, subject conditions, or similar factors beyond our control.
   

3.3 Independence of Photographers

Photographers are independent contractors and are not employees, agents, or partners of SHOOT NOW!. We bear no vicarious or other legal liability for the acts of Photographers.
 

4 – Booking and Payment

4.1 Booking Process

• All bookings must be made in advance through the official booking channels on the Platform.

• A booking is confirmed and the Photography Service Contract between the User and Photographer is established upon receipt of full payment.

• A confirmation email will be sent within 24 hours of booking confirmation.
   

4.2 Nature of Payment

The amount you pay consists of:

• Photographer Fee: The amount received by SHOOT NOW! as agent on behalf of the User, to be remitted to the Photographer as a contractor fee.

• Platform Fee: Consideration for SHOOT NOW!’s matching, booking, and operational services.

SHOOT NOW! acts as an agent that receives the contractor fee on behalf of the User for remittance to the Photographer.
 

4.3 Payment Processing

• All payments are processed in Japanese Yen (JPY) through Stripe.

• Full payment is required at the time of booking.
   

4.4 Session Time

•  The duration of the Session is calculated from the scheduled start time, regardless of the actual start time.

• If a Session cannot begin due to the User’s late arrival, the Session will still end at the originally scheduled time.

• Travel time between locations is included within the session time.
   

5 – Cancellation and Refund Policy

5.1 Cancellations by Users

7 or more days before the session : Full refund

3–6 days before the session : 50% refund

Less than 3 days before the session : No refund

No-show / no contact : No refund

5.2 Rescheduling

• Sessions cannot be rescheduled. Any change of date or time will be treated as a cancellation.
   

5.3 Cancellation Due to Severe Weather

• If severe weather is anticipated, SHOOT NOW! may cancel the session at its sole discretion and issue a full refund.

• The determination of “severe weather” is made solely at the discretion of SHOOT NOW!.
   

5.4 Cancellations by SHOOT NOW! or Due to Photographer Circumstances

If a session must be cancelled due to circumstances on the Photographer’s side or other operational reasons, a full refund will be issued.

 

Limitation of Liability: In such cases, SHOOT NOW!’s liability is limited to the refund of the paid fee, and we shall not be responsible for any additional costs (e.g., travel or outfit rental fees).
 

6 – Session Guidelines

6.1 Shooting Locations

• Sessions take place in public outdoor areas and locations where photography is freely permitted.

• Sessions cannot be conducted in locations requiring admission fees (e.g., interiors of temples/shrines requiring entry fees, paid observation decks, restaurants, commercial facilities, etc.).
   

6.2 User Responsibilities

• Please arrive at the designated meeting point on time.

• Please follow the reasonable instructions of the Photographer during the session.

• Please comply with all local rules and regulations at the shooting location.

• If you wish to extend your session, please confirm your photographer's availability before making any payment. Once confirmed, complete the extension payment through the designated form and show the confirmation screen to your photographer.Please note that if you proceed with payment without first confirming your photographer's availability, and the extension cannot take place due to the photographer's schedule, no refund will be issued.
   

6.3 Prohibited Conduct

The following conduct is prohibited:

• Requesting photography in restricted or off-limits areas

• Engaging in illegal activities during a Session

• Harassment or inappropriate conduct toward the Photographer

• Direct contact with the Photographer (including exchanging contact information)

• Directly commissioning the Photographer outside of the Platform
   

7 – Copyright and Use of Photos

7.1 Copyright Ownership

All copyright in photographs taken during a Session belongs to the Photographer who took them.
 

7.2 License to User

Upon full payment for the Session, the Photographer grants the User a non-exclusive, perpetual, worldwide license on the following terms:

• Permitted uses: Personal, non-commercial use (e.g., personal social media posts, personal printing and storage)

• Prohibited uses: Commercial use, sublicensing, or sale of photographs
   

7.3 Marketing License to SHOOT NOW!

By making a booking, the User grants SHOOT NOW! and the Photographer a non-exclusive license to use the photos for marketing and promotional purposes, including on our website, social media, and advertising materials.

If you do not wish your photos to be used for marketing, please notify us in writing at Contact form before your session. Please note that we cannot guarantee removal of photos already published.
 

7.4 Photo Delivery

• Photos will be delivered as digital files via Google Drive or an equivalent service within 2 business days of the session.

• Photos are provided in high-resolution JPEG format in their unedited, original state.
   

8 – Limitation of Liability

8.1 Disclaimer

SHOOT NOW! accepts no responsibility for:

• The quality or suitability of services provided by Photographers

• Any personal injury, illness, or property damage occurring during or in connection with a Session

• Environmental factors (e.g., weather, lighting, or subject conditions) that may affect photo quality

• Technical failures or delays in photo delivery beyond our reasonable control
   

8.2 Assumption of Risk

By making a booking, the User acknowledges and agrees that:

• Outdoor photography sessions carry inherent risks including uneven terrain, weather, and crowds.

• That the User is solely responsible for their own safety and the safety of any minors or third parties accompanying them.
   

8.3 Cap on Liability

In any event, SHOOT NOW!’s total legal liability shall not exceed the Platform Fee paid by the User for the relevant session.
 

9 – Indemnification

The User agrees to indemnify SHOOT NOW! against any damages or expenses (including attorney’s fees) arising from the User’s breach of these Terms, violation of applicable law, or the User’s conduct during a Session.
 

10 – Force Majeure

SHOOT NOW! shall not be liable for any failure or delay in performance caused by natural disasters, pandemics, governmental action, or other events beyond our reasonable control.
 

11 – Exclusion of Antisocial Forces

SHOOT NOW! represents that it is not, and has no affiliation with, organized crime groups (bōryokudan), organized crime group members, related enterprises or organizations, or any other antisocial forces (“Antisocial Forces”), and that it does not provide funding or other assistance to such forces.

If a User is found to be an Antisocial Force, SHOOT NOW! may cancel the booking and suspend access to the Platform without notice or refund.
 

12 – Changes to These Terms

SHOOT NOW! reserves the right to modify these Terms at any time. Material changes will be announced on our website in advance where reasonably possible. Continued use of the Platform following any changes constitutes acceptance of the revised Terms.
 

13 – Governing Law and Dispute Resolution

These Terms are governed by the laws of Japan. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the Osaka District Court as the court of first instance.
 

14 – Severability

If any provision of these Terms is held to be invalid, the remaining provisions shall continue in full force and effect.
